सुप्रीम कोर्ट ने वक्फ संशोधन अधिनियम 2025 की कुछ धाराओं पर अंतरिम रोक लगा दी है। अदालत ने साफ़ किया कि पूरा कानून स्थगित नहीं होगा, लेकिन कुछ विवादित प्रावधानों पर रोक ज़रूरी है। कोर्ट ने पाँच साल तक मुस्लिम होने की शर्त को मनमाना बताते हुए रद्द किया। साथ ही, वक़्फ़ बोर्ड में गैर-मुस्लिम सदस्यों की संख्या पर सीमा तय की – बोर्ड में 3 और काउंसिल में अधिकतम 4। वहीं, वक़्फ़ संपत्ति के पंजीकरण का प्रावधान जारी रहेगा, लेकिन समय सीमा बढ़ा दी गई है। राजस्व से जुड़े विवाद अब कलेक्टर नहीं, बल्कि ट्रिब्यूनल तय करेगा। यह आदेश फिलहाल अंतरिम है, अगली सुनवाई में अंतिम निर्णय लिया जाएगा।

The Supreme Court has stayed certain provisions of the Waqf (Amendment) Act 2025, while refusing to halt the entire law. The Court struck down the controversial clause requiring a person to be a Muslim for at least five years before creating a waqf, calling it arbitrary. It also capped non-Muslim representation in Waqf institutions – not more than 3 in State Boards and 4 in the Central Waqf Council. The mandatory registration of waqf properties will continue, though the deadline has been extended. Additionally, revenue officials can no longer adjudicate waqf property disputes, which will now remain under tribunals. This is an interim order; the final decision will come in future hearings.
